1. Scope
These Terms and Conditions apply to contracts concluded between S&B Kosmetik GmbH, Lilienthalgasse 9/EG/G03A, 1030 Vienna, Austria (“S&B Kosmetik”, “we”, “us”) and consumers through the online store available at www.specialbeauty.at.
A consumer is a natural person who enters into a transaction for purposes that are predominantly outside their trade, business or profession.
These Terms and Conditions apply to the sale of skincare and cosmetic products, home-use beauty devices, samples, electronic gift cards and other physical goods offered through our online store.
2. Languages
Contracts may be concluded in English, German or Russian, depending on the language selected in the online store.
3. Product Information
The essential characteristics of each product are described on the relevant product page.
Product images are intended to represent the products as accurately as possible. Minor differences in appearance, packaging or presentation may occur, particularly where manufacturers update product packaging without changing the product itself.
4. Ordering Process and Conclusion of Contract
Products displayed in our online store do not constitute a legally binding offer by S&B Kosmetik GmbH but an invitation to submit an order.
You may place products in your shopping cart and review and correct your order before submitting it.
By activating the final order button in checkout, you submit a binding offer to purchase the products contained in your order.
After receiving your order, we automatically send an order confirmation to the email address provided by you. This automated confirmation acknowledges receipt of your order and does not, by itself, constitute acceptance of your offer.
The contract is concluded when we expressly accept your order, dispatch the ordered goods, or otherwise confirm fulfilment of the order.
If we cannot accept an order, any payment already received for the affected order will be refunded using the original payment method.
5. Prices
All prices displayed to consumers include applicable VAT unless expressly stated otherwise.
The prices applicable at the time the order is submitted apply.
Shipping costs, where applicable, are displayed separately during checkout before the order is submitted.
6. Obvious Pricing or Technical Errors
We take reasonable care to ensure that product information and prices are correct.
In the event of an obvious pricing, technical or system error, we reserve the right not to accept the affected order where no contract has yet been concluded.
If payment has already been collected for an order that we cannot accept, the relevant amount will be refunded using the original payment method.
Nothing in this provision limits any mandatory rights of consumers.
7. Payment
The payment methods available for an order are displayed during checkout.
Depending on availability, payment methods may include:
- Visa;
- Mastercard;
- American Express;
- Maestro;
- UnionPay;
- Apple Pay;
- Google Pay;
- PayPal;
- Klarna;
- Shop Pay;
- bank transfer.
For collection from our Vienna location, payment in cash may also be available.
Individual payment methods may be provided by third-party payment service providers and may be subject to their applicable terms.
8. Delivery
Delivery is available to the countries offered for selection during checkout.
The currently available delivery countries, shipping costs and applicable free-shipping thresholds are displayed during the ordering process.
Orders may be dispatched from our fulfilment locations in Austria or Slovakia.
The carrier used may vary depending on the destination country and available delivery service.
Applicable delivery information and estimated delivery times are displayed during checkout or otherwise communicated before the order is placed.
Where no specific delivery period has been agreed, mandatory statutory delivery periods remain unaffected.
9. Free Shipping
Free shipping may be available above a specified order value.
The applicable threshold may vary by destination country.
The currently applicable shipping charge or free-shipping threshold is displayed during checkout.
10. Collection in Vienna
Where offered during checkout or agreed with us, orders may be collected from:

Collection is available in accordance with the collection information communicated for the relevant order.
11. Pre-Orders
Certain products may be offered for pre-order.
Where a product is offered as a pre-order, this will be indicated on the relevant product page before the order is submitted.
Any specific estimated availability or delivery information stated for the pre-order at the time of purchase forms part of the applicable delivery information.
If an ordered product ultimately cannot be supplied, any amount paid for that product will be refunded using the original payment method.
12. Availability
All orders are subject to product availability.
If, after an order has been placed, an ordered product cannot be supplied, we will inform you and, where applicable, refund the amount paid for the unavailable product using the original payment method.
Mandatory consumer rights remain unaffected.
13. Electronic Gift Cards
Electronic gift cards may be purchased through our online store where available.
Gift cards are provided electronically and may be redeemed for eligible purchases from S&B Kosmetik GmbH in accordance with the conditions stated when the gift card is issued.
Our electronic gift cards do not have a contractual expiry date, subject to any mandatory legal provisions.
Gift cards are not redeemable for cash except where required by law.
14. Promotional Codes
Promotional codes are subject to the conditions communicated in connection with the relevant promotion.
Unless expressly stated otherwise, promotional codes cannot be exchanged for cash.
Restrictions relating to validity, eligible products, minimum order values or combination with other promotions may apply where clearly communicated before purchase.
15. Statutory Right of Withdrawal
Consumers entering into distance contracts generally have a statutory right of withdrawal.
Information about this right, its conditions, deadlines and exercise, together with the statutory model withdrawal form, is available on our Right of Withdrawal page.
Mandatory statutory exceptions to the right of withdrawal remain applicable.
16. Statutory Warranty Rights
Consumers are entitled to the statutory warranty rights applicable to their purchase.
These statutory rights apply independently of any voluntary commercial guarantee or additional service offered by S&B Kosmetik GmbH.
Nothing in these Terms and Conditions restricts or excludes mandatory statutory warranty rights.
17. Skincare Guarantee Programme
For certain products personally selected by our cosmetologist, S&B Kosmetik GmbH additionally offers a voluntary Skincare Guarantee Programme.
The Skincare Guarantee Programme is an additional voluntary service and does not replace, restrict or otherwise affect your statutory warranty rights or your statutory right of withdrawal.
The conditions and exclusions of the programme are available on our Skincare Guarantee page.
Products expressly identified as excluded from the programme are not covered by the Skincare Guarantee Programme.

19. Alternative Dispute Resolution
S&B Kosmetik GmbH does not undertake to participate in alternative dispute resolution proceedings before a consumer arbitration body unless required by law in an individual case.
20. Applicable Law
These Terms and Conditions and contracts concluded under them are governed by Austrian law.
Where you are a consumer habitually resident in another country, this choice of law does not deprive you of the protection afforded to you by mandatory provisions of the law that would apply in the absence of this choice.
21. Final Provisions
If an individual provision of these Terms and Conditions is or becomes invalid, this does not affect the validity of the remaining provisions, to the extent permitted by law.
Mandatory consumer protection rights remain unaffected.
